New technologies in the case law of the Court of Justice – lessons learnt and lessons to be learnt

The article identifies the most important legal challenges related to new technologies on the basis of the existing case law of the Court of Justice. The author analyses how these experiences make us re-examine established legal concepts. The discussion focuses on issues such as the principle of territoriality, the protection of personal data, the role of the Internet platform, and liability for infringements committed via the internet. In addition, the author seeks to identify what challenges still lie ahead for courts and legislators.
