<p>Due to rising numbers of suspects in cases involving child and youth pornography offences under Sections&#xa0;184b and&#xa0;184c of the German Criminal Code (StGB), so-called child sexual exploitation material (CSEM), there is a&#xa0;growing need for case-specific risk assessments. In addition to forensic risk assessments that have been standard practice in criminal law proceedings, there has been a&#xa0;growing need for sexual forensic risk assessments in family law in recent years. This primarily concerns male caregivers with use of CSEM and who continue to live in a&#xa0;household with children. Although recent international meta-analyses consistently report low recidivism rates for hands-on offences among CSEM-exclusive offenders, these studies do not report rates on intrafamilial child sexual abuse. As the only publication to date on probation and reconviction of CSEM users in Germany also failed to distinguish the offence of sexual abuse of a&#xa0;person under one’s care, the aim of this study is to evaluate the recidivism risk of individuals convicted of CSEM offences regarding intrafamilial child sexual abuse. The results of the nationwide recidivism study by Jehle and Hohmann-Fricke from 2024 support a&#xa0;very low actual risk of the co-occurrence of CSEM offences and intrafamilial child sexual abuse. Further details of the nationwide survey waves from 2010, 2013 and 2016 are presented and discussed.</p>

摘要

Due to rising numbers of suspects in cases involving child and youth pornography offences under Sections 184b and 184c of the German Criminal Code (StGB), so-called child sexual exploitation material (CSEM), there is a growing need for case-specific risk assessments. In addition to forensic risk assessments that have been standard practice in criminal law proceedings, there has been a growing need for sexual forensic risk assessments in family law in recent years. This primarily concerns male caregivers with use of CSEM and who continue to live in a household with children. Although recent international meta-analyses consistently report low recidivism rates for hands-on offences among CSEM-exclusive offenders, these studies do not report rates on intrafamilial child sexual abuse. As the only publication to date on probation and reconviction of CSEM users in Germany also failed to distinguish the offence of sexual abuse of a person under one’s care, the aim of this study is to evaluate the recidivism risk of individuals convicted of CSEM offences regarding intrafamilial child sexual abuse. The results of the nationwide recidivism study by Jehle and Hohmann-Fricke from 2024 support a very low actual risk of the co-occurrence of CSEM offences and intrafamilial child sexual abuse. Further details of the nationwide survey waves from 2010, 2013 and 2016 are presented and discussed.
