Behandlungsverläufe und Unterbringungsresultate bei nach § 126a StPO aufgenommenen Patient:innen im Berliner Maßregelvollzug

Permanent placements in forensic psychiatric institutions under § 63 StGB (German Criminal Code) are on the rise in Germany. In Berlin the proportion of probationary releases (§ 67b StGB) after provisional placements under § 126a StPO (German Code of Criminal Procedure) is low and has recently decreased. Objectives of the Study were to examine the course of treatment in the context of provisional placement and to identify variables influencing placement outcomes.
MethodsRetrospective analysis of all n = 662 patients in Berlin’s forensic hospital admitted from 2017 to 2022. Logistic regression analyses were used to examine associations between diagnoses and offense-related variables, sociodemographic characteristics as well as pretreatment and treatment characteristics and legal placement outcome (1) § 63 StGB, (2) § 67b StGB or (3) revocation of the § 126a StPO placement order.
ResultsDiagnosis, offense and treatment-related aspects were predictors for the placement outcome.
Positive predictor for § 67b StGB was treatment response. Negative predictors were schizophrenia (F20), substance comorbidity, chronic illness, homicides, previous delinquency, language barriers and violence or assaults during preliminary treatment.
Positive predictors for the revocation of the placement order were substance comorbidity and offenses without physical violence. Negative predictors were schizophrenia (F20), homicides, arson offenses, prior delinquency, and violence or assaults in the KMV.
ConclusionSchizophrenia diagnoses and language barriers could explain the low proportion of § 67b StGB. Since effective treatment is often possible, improvements in discharge management and aftercare services could make § 67b StGB more frequently applicable and enable a reduction in orders under § 63 StGB.
