The amendment of Section 64 of the German Criminal Code (§ 64 Strafgesetzbuch) came into force on 1 October 2023. This article deals with the jurisprudential and experiential prerequisites for its application and is intended to serve as an overview and stimulus for the practice of expert assessment and jurisprudence.
