Zur Anwendung der Neufassung von § 64 StGB bei Jugendlichen und Heranwachsenden – rechts- und erfahrungswissenschaftliche Perspektiven

The amendment to § 64 of the German Criminal Code (Strafgesetzbuch) came into force on 1 October 2023. This article takes a legal and empirical perspective on the particularities of its application to juvenile and adolescent offenders with substance use disorders. Based on empirical findings on juvenile delinquency and the detention of juvenile offenders, problem areas are presented that could arise as a result of the contouring of the requirements for the imposition of Section 64 StGB, and suggestions are made on how to deal with these challenges.
