<p>In the process of change of land-use formerly occupied by potentially polluting activities undergoes due to real estate interest, one of the most used remediation/recovery techniques is the removal, transportation and off-site treatment of contaminated soil. To perform the classification of a soil excavated from a contaminated area, in a great majority of the cases, it is requested by the environmental supervising agencies that its classification occurs through the methodology present in NBR 10.004:2004. Thus, the objective of this study was to perform a critical and interpretative analysis of the interaction of the existing content between the CONAMA resolution 420/2009 and the NBR 10.004/2004 standard. Through the evaluation of the analytical results obtained in a case study, where 06 samples were collected, divided into 03 pairs that were equally submitted to analytical procedures in compliance with CONAMA 420/2009 and NBR 10.004/2004, was concluded that the proposed use of NBR 10.004/2004 for soil classification, especially in the management of contaminated areas, has not been effective, and that the priority understanding about the destination or treatment to which the contaminated soil will be submitted must necessarily be done by the professionals responsible for all stages of management provided in NBR 15.515.</p>
