Comment on Kristin Henrard’s ‘The Margin of Appreciation for ‘State- Religion Relations’: Critical Reflections on the Jurisprudence of the ECtHR and the CJEU’

This commentary is a response to Kristin Henrard’s article, ‘The margin of appreciation for “state-religion relations”’, in this special issue. The author argues that the European Court of Human Rights’ excessive reliance on the margin of appreciation doctrine leads to unjustified discrepancies and, in some cases, a lowering of the level of protection afforded to the right to freedom of religion across Council of Europe member states.
