Reasonable Accommodation for Neurodiversity: Legal, Organizational and Managerial Considerations

Reasonable accommodation refers to an employer’s responsibility to provide a supportive work environment for qualified employees or applicants who meet the standards for a disability under the Americans with Disabilities Act Amendments Act of 2008 (ADAAA). While the ADAAA makes legal provisions for disabled employees and applicants, organizational and managerial variables may impact both the probability that an accommodation is made as well as the nature of the accommodation process. In our review, we first cover the legal standards for disability and for reasonable accommodation and then turn to an examination of specific organizational and managerial factors which impact accommodations. Throughout our review, we offer research-based recommendations that may inform theories of reasonable accommodation and provide advice regarding how to effectively implement reasonable accommodation in firms. We end our discussion by offering empirically based suggestions for creating externally valid models of reasonable accommodation and for helping organizational decision-makers create a more inclusive and neurodivergent-friendly work environment.
