Bergung eines Fetus während einer Obduktion (der Mutter) mit einem Gewicht unter 500 g, aber einem Schwangerschaftsalter von mehr als 24 Wochen – Totgeburt oder Fehlgeburt?
摘要
During the autopsy of the body of a woman allegedly 7 months pregnant a dead fetus was recovered. It was severely altered by putrefaction and myiasis and weighed 405 g, although in view of putrefaction-related tissue loss, a weight of over 500 g at the time of death had to be assumed. The other measurements determined were indicative of reaching the 26th week of pregnancy. Nevertheless, the fetus was classified as a miscarriage based on its weight. According to § 31 Civil Status Act (PStV), which was later amended on 1 November 2018, a classification as a stillbirth would have been possible.
