Stellungnahmen zur Eizellspende und Leihmutterschaft im Bericht der Kommission zur reproduktiven Selbstbestimmung und Fortpflanzungsmedizin
摘要
The Committee on Reproductive Self-determination and Reproductive Medicine instigated by the Federal Government published its report in April 2024. The present article discusses the statements on oocyte donation and surrogate motherhood. The medical, psychosocial, legal and ethical backgrounds of the procedures are presented in detail. The internationally available data are described, particularly data on the medical and psychosocial aspects. Based on this, the legalization of oocyte donation in Germany appears to be feasible. The comments of the Committee are more reserved with respect to the legalization of altruistic surrogate motherhood. Some questions with respect to the performance of both oocyte donation and surrogate motherhood are still open. At the same time, reference is made to the inconsistency of the argumentation when the Committee is in favor of the legalization of oocyte donation but is more in favor of retaining the prohibition of surrogate motherhood. Accompanying medical and psychosocial research appears to be necessary. Overall, the article represents a very good current overview on oocyte donation and surrogate motherhood.
